General terms and conditions

General Terms and Conditions (GTC) of derekdesign

§ 1 Scope of application

(1) These General Terms and Conditions (GTC) apply to all contracts between derekdesign, owner: Antonija Derek, Gudrunstraße 88/1, 1100 Vienna (hereinafter ‘Provider’), and its customers.

(2) By placing an order, the customer recognises these GTC. Deviating agreements require written confirmation.

§ 2 Services

(1) The Provider shall create digital designs according to the Customer's wishes and provide them in the format requested by the Customer.

(2) If a special design is required, this can be printed on request and sent to the customer exclusively by post.

§ 3 Conclusion of contract

(1) The presentation of designs on the website or other platforms does not constitute a legally binding offer.

(2) The customer submits a binding offer by placing an order. The contract is concluded as soon as the provider confirms the order in writing or begins processing it.

§ 4 Prices and payment

(1) The prices for the designs are agreed individually and communicated to the customer in advance.

(2) Payment shall be made exclusively by IBAN transfer to the account specified by the provider.

(3) The customer undertakes to transfer the invoice amount within the specified period after invoicing.

§ 5 Delivery

(1) Digital designs shall be made available to the customer by e-mail or via a download link.

(2) If a printed special design has been ordered, delivery shall be made by post to the address specified by the customer.

(3) Delivery times are agreed individually.

§ 6 Rights of use

(1) The customer shall receive a simple, non-transferable right of use to the designs created.

(2) Passing on, duplication or commercial use is not permitted without the express consent of the provider.

§ 7 Right of cancellation

(1) As these are individually created designs, there is no right of cancellation once processing has begun.

(2) If a design has defects caused by the provider, a free correction will be offered.

§ 8 Liability

(1) The provider is only liable for intent and gross negligence.

(2) Colour deviations between the digital file and the printed end product are due to technical reasons and do not constitute a defect.

(3) The provider shall not be liable for delays or errors caused by third parties (e.g. print service providers or postal delivery).

§ 9 Data protection

(1) The provider processes the customer's personal data exclusively for the fulfilment of the contract and in accordance with the privacy policy.

(2) Customer data shall not be passed on to third parties unless this is necessary for the fulfilment of the contract.

§ 10 Final provisions

(1) Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

(2) The place of jurisdiction is Vienna.

(3) Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
